Tuna fishing

To the core: New fishing licenses for “any and all modalities” of tuna fishing in Brazil have been suspended indefinitely. The only exception is for so-called “associated school fishing,” in which the boat itself acts to attract fish. This week’s suspension does not affect the prior fishing licenses granted before the publication of the ordinance.

Some context: Tuna fishing has become controversial worldwide, and with the shortage of fish around the world, Brazil has become one of the preferred targets for tuna fishing. In this contest, Brazilian fishers have struggled with an increased presence of foreign

These licenses were an obligation implemented in 1987. Today, 72 associations are licensed in the ministry, among them the Brazilian Association of Zebu Breeders, responsible for one of the most significant events of Brazilian agriculture: the ExpoZebu, in Uberaba, Minas Gerais. In December 2017, the now extinct Ministry of Labor issued an ordinance prohibiting the charging of the so-called &#8220;rebate&#8221; fee, in which companies such as Sodexo, Ticket, and VR applied a discount to companies benefitting from the Program of Workers&#8217; Meals on the burden of feeding employees. </span></h5> <h5><span style="font-weight: 400;">Thus, for example, if a company paid BRL 400 in meals to an employee, the middle-man would charge them not BRL 400, but BRL 380, in the case of a 5 percent discount. This difference was made up with a higher tax on restaurants. The government understood that this system provided a double benefit for companies, as they also have the right to deduct up to two times the amount paid in meal tickets from their corporate income tax calculations. Over 260,000 companies take part in this program.</span></h5> <h5><b>Other important aspects to bear in mind: </b><span style="font-weight: 400;">With this week&#8217;s suspension, all acts resulting from it are also annulled. In other words, contracts between a company and meal card companies signed based on these rules would, in theory, be invalid, and new agreements could be made based on the previous model, with the rebate fee. They will be responsible for the monthly payment of contributions. This demand had already been set some time ago, but now it has been regulated. </span></h5> <h5><span style="font-weight: 400;">Individual taxpayers must pay 20 percent of their monthly income up to the limit established by the INSS—which today is a monthly contribution of BRL 1,167.89 (which would require the driver to make over BRL 5,800 a month, which is rare). Now, the Inep has created a &#8220;Board of Collaborators,&#8221; which will be made up exclusively of teachers or researchers from basic or higher education. They will work on demand and will receive Educational Evaluation Assistance as remuneration. Artisanal or homemade products which have ingredients of animal origin may no longer enter the country. For instance, forget about bringing home that French cheese, bought directly from the producer. </span></h5> <p><span style="font-weight: 400;">Another important restriction which was not included in the previous rule is that the labels of products must be in either Portuguese, English, French, or Spanish. Other languages will not be permitted. This means any products of animal origin—regardless of whether they are artisanal—without a label in one of these accepted languages, will be barred upon entry in Brazil.</span></p> <h4><b>Other important aspects to bear in mind:</b></h4> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">The new rule does not establish any weight limits. Countries should submit forms to the Agriculture Defense Department specifying the products intended for import, and all must have sanitary certificated. The request to the ministry must be made 30 days in advance. Whether this will mitigate problems, time will tell. Previous rules stated that authorization for new contracts (or renewals) of above BRL 10 million was the responsibility of several internal departments of the ministry. For contracts of between BRL 1 to 10 million, authorization was up to the administrative matters sub-department of the executive department. Among the rules to be followed by those providing this service is the existence of a multidisciplinary team &#8220;made up of a support team comprising doctors and vets and a minimal treatment team with a psychologist, physiotherapist and an equitation professional.&#8221; Other professionals may also be included in this team, meaning that the process is not a simple one. The horse also must be trained exclusively for equine therapy, and emergency health care must be ensured. The deadline to complete this work is for two months. During these extended opening hours, units may perform all procedures and services they currently offer during their regular times. The incentives will be as follows:</span></h5> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">12 hours of uninterrupted service on working days, or 11 hours of continuous service, plus 5 hours on Saturday and Sunday (excluding dental health teams).</span> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">Minimum of three family health teams.</span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">BRL 10,695 a month per family health team + BRL 10,695 per month for each health unit + single payment of BRL 22,816.</span></li> </ul> </li> <li style="font-weight: 400;"><span style="font-weight: 400;">12 hours of uninterrupted service on working days, or 11 hours of continuous service, plus 5 hours on Saturday and Sunday (including dental health teams).</span> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">Minimum of three family health teams + two dental health teams.</span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">BRL 10,695 a month per family health team + BRL 4,470 per month for each dental health unit + BRL 15,165 per month for each health unit + single payment of BRL 31,766.</span></li> </ul> </li> <li style="font-weight: 400;"><span style="font-weight: 400;">15 hours of uninterrupted service on working days, or 14 hours of continuous service, plus 5 hours on Saturday and Sunday (including dental health teams).</span> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">Minimum of six family health teams + three dental health teams.</span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">BRL 10,695 a month per family health team + BRL 4,470 per month for each dental health unit + BRL 30,330 per month for each health unit + single payment of BRL 59,866.</span></li> </ul> </li> </ul> <h5><b>Other important aspects to bear in mind:</b></h5> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">For each of the formulas above, each municipality may put together an extra two family health teams, thus automatically increasing transfers from the government.</span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">Health units taking part in the program will be evaluated and monitored by &#8220;essential&#8221; indicators. These will be made available on the Health Ministry&#8217;s website.</span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">Around the country, there are currently 2,289 out of 42,000 health units capable of signing up for this program, according to the ministry. According to the new articles added to the law, whenever the existence of &#8220;current or imminent risk&#8221; to the life of a woman or her children is observed, the aggressor must be &#8220;immediately removed&#8221; from the house. </span></h5> <p><span style="font-weight: 400;">This can be carried out by an on-call police officer when there is no police chief available at the time of the complaint. In these cases, the judge must be informed within 24 hours and will decide, within the same time frame, on upholding or suspending the measure. In other words, aggressors may be removed from their house without a warrant from the court. </span></p> <p><span style="font-weight: 400;">However, the wording is unclear over the practical procedures to be adopted. For example, the arrest of the aggressor is now strictly provided, only his &#8220;removal&#8221; from the house. Would a recording be enough? This means that tax debts, even those which are usually not able to be paid back in installments, may now be repaid over time. Previous rules established a limit of BRL 1 million. Debts can be repaid over up to five years (60 months), but the minimum repayment for individuals is now BRL 200 (and not BRL 100). However, for requests made before September 30 this year, the minimum repayment falls to BRL 100. For companies under court-supervised reorganization, the minimum repayment is only BRL 10, when requested before September.</span></h5> <h5><b>Other important aspects to pay in mind:</b></h5> <ul> <li style="font-weight: 400;"><span style="font-weight: 400;">In the case of debts to the Public Treasury, listed on the unpaid federal debt, which have already been demanded in court and are guaranteed by the freezing of assets, installment plans will be analyzed on a case-by-case basis, with the General Counsel for the Federal Treasury (PGFN) deciding on the convenience of each agreement. The PGFN may also demand the advance payment of 30 percent of the debt to permit repayment schedules. </span></li> <li style="font-weight: 400;"><span style="font-weight: 400;">In the case of debts up to BRL 1 million with the Public Treasury, the individual or company will not need to submit guarantees to obtain permission for repayment plans. For amounts above this limit, repayment depends on the submission of assets as guarantees or surety backed by a third party.
